A 15 year old Moroccan teenager, Amina Filali was raped and subsequently forced to marry her rapist, despairing of justice Filali committed suicide.

Rape victims being forced to marry their rapists is an ancient practice that existed in many cultures throughout history, and is a real problem all over the world today, especially in Africa, Asia and Latin America.

What compounded the crime was that not only was Filali forced to marry her rapist but Moroccan law was not on her side. The legal system in Morocco integrated this abhorrent cultural phenomenon in the 1950′s.

Islamophobes were quick at the time to misattribute the practice to Islam. For instance hate-monger Robert Spencer wrote:

This is done because the focus in Islam is not on the rape at all, but on the shame the woman has brought to her family by her sexual immorality, even if she was forced. That shame is erased if the rapist marries her.

Not to be outdone, the looniest blogger ever, Pamela Geller wrote:

More female empowerment under the sharia (Islamic law).

These were just two of the most prominent Islamophobes commenting on Filali’s death, hundreds of hate-blogs and sites in the Islamophobic looniverse echoed such commentary, sprinkling in their own anti-Muslim spin.

The misattribution of such cases and issues to Sharia’ and Islam is of course part of the well-worn demonization war that Spencer, Geller and their cohorts have been waging for years now. Facts are unimportant in this war, any crime or heinous action committed by a Muslim must be assigned to Islam goes their thinking. Lying to prove their point is not an impediment.

What they and their drone like blind followers will conveniently overlook for instance is that,

“…in 12 Latin American countries…rapist can be exonerated if he offers to marry the victim and she accepts…In Costa Rica, he can be exonerated even if she refuses his offer…” (UNICEF)

The majority of these nations are Catholic Christian, are we then going to blame Christianity for these laws?

If one wished to play a tit for tat it could easily be pointed out to the Islamophobes that it is in fact the Bible which commands a raped woman to marry her rapist, not the Qur’an,

“If a man happens to meet a virgin who is not pledged to be married and rapes her and they are discovered, he shall pay the girl’s father fifty shekels of silver. He must marry the girl, for he has violated her. He can never divorce her as long as he lives.” (Deuteronomy 22: 28-29)

Sadly, what is obfuscated and lost when the hate-mongers resort to racist tropes and Orientalist misattributions are the intrepid activists, the Muslim and Arab feminists who are fighting to change laws that can lead to such tragic results in their countries:

    hmm…perhaps rapists would be executed under sharia law, but i heard it’s almost impossible to prove rape there, for it needs four MALE witnesses who saw the rape. when will that ever happen? therefore if the woman’s rape allegation is not proved (meaning she has no 4 male witnesses who saw the rape take place), she’s condemned as a hussy, and the rapist goes free.

    As I recall when visiting Morocco for a couple of months back in the 90′s, the women who populate the sex resort town of Agadir (frequented by Europeans) were there (sometimes), I was told, because of a rape or some other issue that caused them some “shame”. Morocco does have a certain amount of backwardness in the way it treats women.

    So the news has just broken that a Moroccan girl has committed suicide after being ordered by a judge to marry her rapist. Now before some self-righteous Christians begin mouthing off about how unenlightened Islamic culture is, let’s go to the source:

    “If a man meets a virgin who is not engaged, and forcibly seizes her and lies with her, and they are caught in the act, the man who lay with her shall give fifty shekels of silver to the young woman’s father, and she shall become his wife. Because he violated her he shall not be permitted to divorce her as long as he lives” (Deut 22:28-29).

    Now this law is often decried by religion’s detractors as barbaric and misogynistic. In fact, however, this law is designed specifically with the woman’s well-being in view. In many ancient cultures, women enjoyed second-class status. Societies were dominated by males, and women were objects to be traded from one male to another. This is not a religious problem, so much as a vestige of homo-sapiens’ evolutionary development. But in such cultures, especially in Hebrew culture, women who were victims of rape were considered “spoiled.” The law, in effect, says, “You broke it, you buy it.” In these cultures women depended upon men (fathers, husbands, and sons) for their well-being. In Israelite society, women could not own property; neither could they make contracts without the approval of their male master. This means that a woman was totally dependent upon a man for her survival. But once a virgin had been subjected to sexual violation, she was considered undesirable. Thus, the law dictates (as punishment) that the rapist must marry his victim and, more pointedly, that he is not permitted to divorce her. This law, though obviously very psychologically destructive to the woman (yes, even in an agonistic society), sought to secure the woman’s well being.

    So it isn’t the law here specifically that’s evil, barbaric, or what have you. What’s evil and barbaric, rather, is the culture itself—the male-dominated society, the culture that sees unmarried non-virgins as less than a woman, the culture that does not permit a woman to own property, to conduct her own business arrangements by making contracts and vows, or to decide for herself whom she wishes to marry. What’s more, note that there is no mention in this law of whether or not the woman might wish to secure a divorce from her rapist/husband. Women did not have the right to pursue a divorce; that right, too, was solely within the domain of the male.

    So what should be attacked by modern detractors of Near Eastern religious morality is not this law itself (which, within its context, had a relatively compassionate intent). What should be attacked is something more basic: the culture. This law only really becomes problematic once modern-day Christians (or Jews or Muslims) wish to argue that the culture of God’s people was shaped by God—that God intervened to create in Israel a civilization that reflected God’s own nature, as a just and loving God. There is nothing distinctive at all about the view of women reflected in the Mosaic law. On some points, there are small improvements over other societies in their period; on other points, there are remarkable regressions. There is nothing revolutionary about Israelite culture, when it is compared evenhandedly to its neighbors.

    Aside from the rape law in Morocco, here is another way Muslims have seriously erred. The return of Isa Ibn Maryam (AS) is not articulated in Al Quran. If you examine where it came from, it came from Christians. Same with with stoning for adultery came from the Israeliyat sources. Indirectly Muslims have incorporated Christian and Jewish teachings even when they clash with what it says in the Al Quran.When we have Al Quran we do not need a Messiah. We need to rid Islam of these teachings. Alas it will not happen, as foretold in the Hadeeth above.

In view of the above considerations it is doubtful that these traditions go back to the Prophet of Islam. They should be rather regarded as the views of some early Muslims, which, as we shall see later, nevertheless have some value and validity.

    from the Christian lore and polemic literature.

    In making Jerusalem the final site of the triumph over good and evil, in completely taking Mecca out of this eschatological picture, the hadith left the domain of classical eschatology and entered partially into what Buchanan temed “syntelealogy”. This he defined as the expectation of the end of an undesirable political era to be followed by the Kingdom of God on this earth, centred around Jerusalem” (1967: xxiii).

    It is inevitable that such research will become more widespread, for the numerous contemporary “back to Islam” movements, while nothing new in concept, consist of a generation of Muslims who are now far more literate than in earlier times. This, as McDonough pointed out, changes the authority of those who used to be sole interpreters of
    the Qur’Sn ( 1984:82-83). The views of the classical exegetes are now open to questioning that would have been unthinkable in earlier times. Arab centric and dogmatic refractions can be left aside for concentration on the actual rhetoric and historical analyses of documents.

    This thesis only focused on a specific area of S&& Muslim for Jewish and Christian provenance and showed that several eschatological concepts have no foundation in the Qur’an. The Zoroastrian, Buddhist, Gnostic and other influences need to be investigated in a similar setting, where devoid of tendentiousness and restriction, benefit
    can be made of modem research techniques. It is almost certain that paying attention to Professor Fazlur Rahman’s “desideratum of the fmt order” will produce a change in Muslim theological and eschatological outlook.

    @Abdul-Rahman, the fact that the “West” is backing this monarchy dictatorship has nothing to do with the disgusting “law” imposed solely by the monarch dictator, but is primarily based on how the monarch dictator is willing to go far imposing “laws” that attempt to suppress further the rights of citizens under his boots, and any tactic is good, whether is via religious or secular, it’s been their tactics and it’s well known. And what’s with the invocation to Taliban nutjobs “ways”? Hush child, please don’t invoke the backward minds! The Taliban’s “ways” are brutal extremist ways that need to be cleansed from their minds at once, and is largely due with their ways at vehemently pushing-back against the two imperialist powers that invaded their country for the past 40 years-(in counting), and thus may be comprehensible but seriously need well-awaited re-education and rehabilitation at coming back their aggressive warlords ways of thinking, including that of the Wahabbist extremist way of thinking they adhere to.     I think we can agree that this was a heinous crime that violates the tenets of Islam and its Message, but we can do this with without launching into a defense of the Taliban. In fact it makes no sense.

    Mullah Omar, one of the leaders of the Taliban, personally authorised the massacre of 6000 civilians, mostly women and children, in August 1998 in the Afghan town of Mazar as his Pashtun forces battled the Tajik forces of Masood and the Uzbek Forces of Dostum. Omar, like the Taliban and the warlords, received/receives no punishment. May he rot in hell along with this rapist.

    Under Islamic Shari’ah law rapists are to be EXECUTED, in fact isn’t this the kind of thing (the Hudood punishments for crimes in Shari’ah law) that Islamophobes often bring up and harb on?!     If the Taliban was in Morocco (say what else you will about them, putting aside the FAKE alleged “acid throwing” stories made up by their enemies and claims they don’t allow girls to go to school: they simply didn’t allow girls to attend school with boys or go to any school that had any un-Islamic Westernized things in their view and interpretation) the rapist would have been brutally executed long ago!
