A very good and long overdue article on the right-wing witch-hunt against CAIR.

The conspiracies and vilification of CAIR have been incessant over the years. For instance, in 2009, Newsweek labeled the idea that “CAIR was sending Muslim spy interns into the halls of Congress” one of the wackiest conspiracy theories of 2009!

The Vilification of CAIR

The is the first in a two-part series on the vilification of the Council on American-Islamic Relations (CAIR) and how the American Muslim community has responded.

There is only one national organization in the United States whose primary mission is protecting the civil liberties of American Muslims, and that is the Council on American-Islamic Relations, commonly referred to as CAIR.  Since its inception in 1994, CAIR has battled countless smears and attacks against its work and reputation, which intensified after being named an unindicted co-conspirator in the notorious Holy Land Foundation case in 2007.

In the past five years, this designation has resulted in witch-hunts on Capitol Hill — a repeated talking point for Islamophobes — and most significantly, the severing of ties by the FBI.  A concerted effort to marginalize CAIR by certain right-wing groups and individuals, built on the meaningless label of “unindicted co-conspirator,” has resulted not only in the FBI distancing itself from CAIR, but other Muslim organizations doing so as well. The ongoing campaign against the group has succeeded; CAIR has
effectively been turned into the black sheep of American Muslims organizations.

At the root of allegations against CAIR is its inclusion in a list of almost 250 other organizations designated as unindicted co-conspirators by the Department of Justice in a case against the Holy Land Foundation (HLF).  What exactly is an unindicted co-conspirator?  For all intents and purposes, this title is used to identify parties to an indictment for the purpose of immunity or evidentiary concerns, but its use is heavily criticized and warned against by the U.S. Attorney’s Manual itself.

An unindicted co-conspirator has not been charged with any criminal misconduct, and the common legal practice is to keep such identification under seal with the court. Making these identifications public raises serious due process concerns, since it effectively destroys the reputation of an individual or group that has not been charged with any crime, without providing it a forum to defend itself like someone who has actually been charged with a crime. In the HFL case, this list of 250 unindicted co-conspirators, including CAIR, was made public when it should have kept under seal.

CAIR and other groups appearing as unindicted co-conspirators in the HLF case petitioned the court to remove its name from that list, but failed.  The stigma of this label continues to haunt CAIR as the lynchpin to a widely propagated narrative that CAIR is the domestic front to foreign terror groups.

It is a talking point that will not die. Recently when Best Buy sponsored a CAIR event, an avalanche of petitions and protests erupted, and the Muslim darling of the Islamophobe industry, Zuhdi Jasser, promptly appeared on Fox news to reiterate the litany of smears associated with CAIR.  The investigation of CAIR interns in Congress, the Peter King hearings, and even statements from pundits like former U.S. Attorney General Michael Mukasey, who recently spoke at an ABA Homeland Security Conference (at which I was personally present),  continue to keep the narrative alive.

At the homeland security conference, I took the opportunity to ask Mr. Mukasey, since he spoke at length about CAIR being a front for Hamas and the Muslim Brotherhood, how a terrorist group could openly continue to operate in the U.S. If his allegations held any merit, why hadn’t the FBI shut them down yet?  Did Mr. Mukasey have evidence the FBI didn’t?

The response, although vague, did point out that the FBI still bars any official engagement with CAIR, which is the larger problem. The FBI’s stance on CAIR, which feeds into the right-wing conspiracy about the organization, has badly damaged CAIR’s reputation and driven away supporters, stripped CAIR of due process, impaired American Muslims’ access to civil liberties advocacy, and harmed the work of the FBI itself by creating distrust from American Muslims.

The greatest irony of this debacle is that not only does CAIR continue to work with other federal, state, and local governments and agencies, but they also continue to work with the FBI in an unofficial capacity. The FBI is routinely engaged by CAIR when hate crimes against Muslims arise, the two groups appear at events together, and on a local level across the country, FBI agents have expressed their hope to Muslim leaders that the official FBI policy towards CAIR will eventually be resolvedso they can continue to work together.

Although the FBI’s official ban of engaging with CAIR has not impeded the organization’s work in any meaningful way (they continue to strongly advocate and litigate civil rights issues), plenty of damage has been done. The group has lost a tremendous number of members and donors, Islamophobes continue to use this point to validate their smears, and other Muslim organizations have been forced to choose whether to align with CAIR and risk their own reputations and legitimacy, or abandon CAIR to be able to continue their own work.

    What’s more, the judge and prosecution were both taken to task by the legal community for their highly unusual behavior during the trial.

    @”keep trying”: May I suggest that you keep, or rather start, trying to better your grammar? The first word in a sentence should have a capital letter. So should proper nouns, regardless of where they appear in a sentence. Are you familiar with those things called apostrophes? And finally, commas aren’t the same thing as periods.

    As for the “unindicted co-conspirator” label it is something the US government (especially under the Zionist AIPAC agents of the “Israeli” regime controlled neo-con filled Bush regime) used to try to smear people they didn’t like. And more often then not the “evidence” against these supposed “unindicted co-conspirators” turns out to be even more pathetically weak then the typical FBI frame ups that go on (and have gone on since at least the 1960s COINTELPRO days with the US government against, assassinating, etc. members of the Black Panther Party: http://en.wikipedia.org/wiki/COINTELPRO)

    And as for the Holy Land Foundation “trial”, brought up in this article, it was one of the most unfair, Zionist controlled miscarriages of justice ever. The prosecution was able to present as supposed “evidence” an unnamed Zionist entity intelligence officer from the “Israeli” Shin Bet who only had to gave the pseudonym “Avi” as his “identification” to the court and even the judge. In fact the whole world (even the US government) and even a large segment of the “Israeli” population freely admits that the Zionist entity’s occupation of the 1967 lines (the Gaza Strip, the West Bank, the Golan Heights of Syria, etc) is completely illegal under international law (and the fact of this Zionist occupation being completely and entirely illegal is also confirmed by all international law organs and the UN).

    @JD…I read an article on that topic a few days ago on yahoo. What I found most interesting was that women are barred from the event. Many Yahoo readers pointed that out saying where was the outrage over that. If they had been Muslim, you know that would have been used by the Islamophobes as an attack on Islam.

    As for the article, CAIR does a lot of great things for our community however I think sometimes they are media whores.

    Many years ago, a pastor by the name of Creighton Lovelace posted a sign on his Church saying the “Koran should be flushed down the toilet”. My sister, who is not outspoken, was the first Muslim to speak out against it. She lives only a few miles away from there and had to drive by that hateful sign on her way to work.

    Not too long after my sister’s statements to the press, the story went national and then international. Media agencies from around the world contacted my sister. Quite a few of them stated that CAIR had contacted them to give statements to the press. I won’t go into detail too much, except to say that my family and I got the impression that CAIR was more concerned about getting its name in the press than the cause at hand.

    An unindicted co conspirator is a person who has not been charged with any criminal activity. This means that large numbers of Americans regard CAIR as a dangerous organisation because it has not been charged with any crime. To be fair it’s possible that most of the anti CAIR crowd are simply illiterate and do not understand the meaning of their own speech. But the fact that a former Attorney General seems incapable of coherent thought raises some interesting issues about the quality of the American justice system, the education one finds in that country and the effect it has on American society in general.

    I may not like CAIR to much nor would I want them as my spokesperson (I think they are wayyyyy to pushy at times and have a habit of jumping in when not needed) but hate group? No more than people like the ADL or anyone else of a similar nature. Yes, any group that choses to fight for one particular minority will come across as pushy towards other minorities but its sad they have to exist at all since in this day and age it seems you either fight or curl up and get trodden on. Besides, the amount of conspiracy theories surrounding CAIR is just laughable, you’d think they ran the US government by now!

As The Independent’s Ben Lynfield reported back in 2009, Haredim across the world see the Internet as a threat to their conservative way of life and feel it could promote future generations to leave the fold and join the larger, secular society. Prominent rabbis in Jerusalem, for example, have attempted to prevent Internet use by rabbinical seminary students through wall posters and firm sermons. “We consider it to be very dangerous,” ultra-orthodox rabbi Yitzhak Goldknopf told Lynfield. “It is something that is liable to cast down a lot of casualties.” CORRECTION: An earlier version of this article incorrectly stated that the rally would be held at Shea Stadium, which has been demolished.

    No! CAIR is not a hate group. CAIR is a civil rights group. Jihad Watch, Bare Naked Islam, Logan’s Warning and Act for America are hate groups. Don’t just take My word or Loon Watch’s word for it. Talk to Mooris Dees of the Southern Poverty Law Center, or Abraham Foxmen of the Anti Defamation League. All of those have been correctly given the designation of Hate group by both organizations, except maybe Logan’s Warning, but that’s only because its not that well known. Anyone who goes on that site who is not an Islamophobe will quickly see it for what it is.
