County Appeals Judge’s Ruling On Mosque Approval

MURFREESBORO, Tenn. (AP) – Rutherford County officials are appealing a judge’s ruling that voided the construction approval for a local mosque.

Chancellor Robert Corlew last month ruled that the county violated Tennessee’s Sunshine Law by not providing sufficient notice for the May 2010 meeting where the mosque was approved.

County attorneys argued that officials followed their standard procedure for informing the public of that meeting.

In his ruling, Corlew implied that they should have taken additional steps because of the intense public interest in the Islamic Center of Murfreesboro.

On Thursday, county attorneys filed a notice of appeal.

In the notice, they question whether requiring a different standard of public notice for the mosque is a violation of the U.S. Constitution and Tennessee Constitution.

    Was there less notice of this than of other buildings or is this the standard notice of business for the county?

    Was there anything substantial in the building of the mosque that went against the community? I have seen that there are huge church complexes much closer in to town and neighborhoods in Murfreesboro, while the mosque is on the outskirts of the town and not in a heavily trafficked area. For them to retroactively shut down the building of the mosque when the community built it in good faith is a travesty-its not like some homeowners who break zoning laws w/o notifying the county and then whine about it when their home is demolished (happened n a community in WA state)

    Laws are laws. Laws of NOTICE are laws. This only demonstrates an objectivity that one gains thru deep thought, not emotion. Let the people deal with the law, that is what this nation is based on.

    Clearly the Judge is off base. He knows better than to imply that their should be different standards for different groups.
    The county officials are to be commended for appealing this judge’s ruling.
    Due to demonstrated lack of objectivity, this judge should step down or be removed from the bench.
